    Principles of personal data protection processing

    Personal data controller

    The administrator is entitled to request proof of your identity in order to prevent unauthorised access to your personal data.

    The administrator did not appoint a data protection officer.

    Legal basis of personal data processing.

    HUTIRA – BRNO processes personal data in accordance with European Union law, in particular in accordance with Regulation No. 2016/679 of the European Parliament and the Council of 27th April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”) and national legislation, which is in particular Act No. 110/2019 Coll., on the processing of personal data (hereinafter referred to as “OCT”) and Act No. 480/2004 Coll., on certain information society and analysis services, as amended.

    The legal reason for processing your personal data is:

    • the fact that such processing is necessary for performing of a contract between you and the Administrator, or the implementation of measures before the conclusion of such a contract within the meaning of Article 6 (1) (a). (b) GDPR, or
    • it is the realisation of the legitimate interests of the Administrator, or
    • you have given your consent to the processing of your personal data.

    In the event of a contractual relationship, the Administrator sends its business partners and customers a business message containing news, products, discounts, benefits and current events in HUTIRA – BRNO (hereinafter referred to as “Hutira News”), due to the realisation of legitimate interests

    HUTIRA – BRNO in the form of limited direct marketing. In each e-mail message with Hutira News, the Administrator allows you to unsubscribe from Hutira News at any time, or allows you to object to such processing.

    The administrator uses cookies on his website www.hutira.cz, i.e. data about visits to this website. Processing is only possible on the basis of your consent to the use of the relevant cookies.

    
    
    
    
    

    Scope of processing your personal data

    The Administrator will provide the personal data provided by you, namely name, surname, e-mail address or telephone number, name of the organisation, job position and other personal data that you provide to the Administrator, to this extent during your registration in the “partner section” on the website. Administrator www.hutira.cz, or obtained from you when concluding the contract or granting consent to processing.

    The purpose of processing your personal data

    The administrator processes your personal data in connection with the sale of goods and the sending of Aktualit Hutira under the conditions and within the limits set by the applicable legislation, in particular in accordance with the provisions of Article 6 (1) (a). a) and b) and f) of the GDPR, and further within the meaning of Act No. 480/2004 Coll., on Certain Information Society and Analysis Services, as amended, for the following purposes:

    • contacting and providing the information requested by the data subject (name, surname, e-mail address);
    • fulfilment of a contractual obligation or implementation of measures before concluding such a contract (name, surname, name of the organisation, job position, e-mail address or address, telephone number);
    • direct marketing database (name, surname, e-mail address);
    • direct marketing (name, surname, e-mail address);
    • registration of a new partner in the “partner section” on the Administrator’s website www.hutira.cz (name, surname, e-mail address)

    If you have enabled storage of cookies in your browser and you agree to their use, we obtain data on website visits. You can also set your browser not to accept cookies.

    The period for which we will process your personal data

    The administrator will process your personal data for the time necessary to ensure mutual rights and obligations arising from the contractual relationship, i.e. for the entire period of contract performance, or for as long as the legitimate interest is present.

    Hutira news is sent for the entire period of consent to it being sent, or for the entire period for which the legitimate interest of the Administrator is given, until its collection is unsubscribed, or until an objection is raised against the processing of personal data for this purpose. If approved, Hutira News is sent (and personal data processed) for a maximum of 10 years. The Administrator will then ask for consent again.

    Further processing of personal data beyond the above is carried out only if it is necessary for the fulfilment of obligations arising from legal regulations that apply to HUTIRA – BRNO.

    As soon as the purpose of the processing has ceased or the Administrator no longer has any legal reason for the processing of personal data, the Administrator will delete the personal data.

    
    
    
    
    

    Persons who have access to your personal data

    The Administrator and its employees will have access to your personal data. Do not share your personal information with third parties. This does not affect the legal obligations of the Administrator or his defence in court.

    Your rights under the GDPR

    You have the right, without any penalty or disadvantage, to withdraw your consent at any time, request the correction or deletion of personal data and/or supplement personal data, request processing restrictions, raise an objection or complaint against the processing of personal data, request data transfer, request access to their personal data, by notification to the electronic address info@hutira.cz. You also have the right to delete personal data if the personal data is no longer needed for the purpose of processing, or if you have withdrawn your consent to its processing, have objected to the processing of personal data and there are no overriding legitimate reasons for processing. You also have the right to be informed about breaches of personal data, their deletion and other rights set out in the GDPR.

    The right to object

    You have the right to object to the processing of your personal data if it concerns you on the basis of Article 6 (1) (a). f) GDPR (processing is necessary for the purposes of the Administrator’s legitimate interests). An objection can be submitted to the Administrator. In the event that you object, the Controller will not further process personal data to this extent unless it provides compelling legitimate reasons for the processing which outweigh your interests or rights and freedoms or the determination, exercise or defence of legal claims. In the case of processing personal data for the purposes of direct marketing, you have the right to object at any time to the processing of personal data concerning you for this marketing. In this case, personal data will no longer be processed for this purpose. More detailed information on this right is contained in particular in Article 21 of the GDPR.

    The right to file a complaint with the supervisory authority

    You have the right to file a complaint concerning the processing of your personal data or the failure of the Administrator arising from the GDPR to the supervisory authority. The competent supervisory authority in the Czech Republic is the Office for Personal Data Protection with its registered office at Lt. Col. Sochora 27, 170 00 Prague 7, www.uoou.cz.

    The obligation to provide personal data and the consequences of not providing it

    You provide your personal data to the Administrator completely voluntarily and it is at your discretion whether you want to enter into an agreement with the Administrator, subscribe to Hutira News or log into the partner section on the website www.hutira.cz. You are not required to provide personal information and you will not be penalised if you do not provide it. However, if you do not provide personal data, the Administrator will not send you Hutira News in particular and you will not have access to the partner section.

    Safety

    The personal data of the data subject is secured by the Administrator through set technical and organisational measures.

    Access to this personal data by the Administrator’s employees is protected by a password and firewall.

    If the Administrator has provided you with (or you have chosen) a password that allows you to access certain parts of the Administrator’s website, you are responsible for keeping that password confidential. You may not share your credentials with anyone else and you authorise the Administrator to act on instructions and information from any person who enters your credentials.
